Commercial Litigation
The firm provides a full service commercial collection department to handle cases in courts throughout the entire state of Missouri, southern Illinois and the entire state of Kansas. The commercial collection department utilizes attorneys and collectors. Attorneys monitor claims at the outset and keep abreast of the status throughout all phases of the collection process. In addition, attorneys maintain constant communication with clients. The collectors initiate contact with the debtor via personal visits or telephone conversations to establish payment terms. Collateral services such as in-house skip tracers and a vast database of debtors are utilized by collectors to locate important information. Fees are generally contingent, with the exception of hourly fees required in some matters. In addition, the department will handle the defense of counterclaims and appeals on an hourly fee basis. We offer a full complement of workout programs including the rehabilitation or liquidation of the debtors assets, such as assignments for the benefit of creditors, receiverships, and other programs.
Retail Collection
Kramer & Frank, P.C. handles consumer claims in all courts of Missouri, southern Illinois and all of Kansas. The department consists of attorneys, collectors, collection administrators and an administration assistant. The attorneys manage all cases on pending court dockets, including the filing of discovery, trials and the use of post judgment remedies. Collectors make initial contact with debtors for demand of payment by way of telephone and personal conferences. If a payment arrangement can not be achieved, the file is transferred to collection administrators for review to make recommendations to clients regarding the filing of suit. When suit is filed, the administrators monitor the collection efforts until the account is collected or deemed uncollectable. The services of an in-house skip tracer are utilized to provide administrators with pertinent information regarding debtors. The attorneys and collectors are supported by administrative assistants. Fees are generally established on a contingent basis, but are adaptable to the needs of our clients.
Litigation
The firm provides complete civil litigation services on behalf of creditors in Circuit, District and Federal courts. We are experienced in all areas of general commercial litigation for secured and unsecured creditors, as well as special actions including replevins, attachments, injunctions, mechanics liens and probate claims. Attorneys handle all phases of the litigation process, including investigation, discovery, trial, securing judgment and collection of judgment. Paralegals assist the attorneys in the collection and litigation procedures. Fees are established on a contingent fee or hourly basis, but are flexible to accommodate the needs and desires of clients.
Medical Collections
The medical collections department of Kramer & Frank, P.C. represents many large hospitals. Like the retail department, the attorneys handle all aspects of medical collections pending in Associate, Circuit and Federal courts. Our collection administrators are highly skilled and experienced in the handling of medical accounts. The medical section employs a director who is responsible for overall supervision of the collectors. We have developed a program to handle special needs, such as workers' compensation claims, special hospital lien claims and claims where the debtor has hired an attorney. In addition, we handle denied Medicare/Medicaid and commercial carrier insurance claims.
Bankruptcy
This department represents creditors, both secured and unsecured, including many banking institutions and credit unions, in bankruptcy proceedings. The bankruptcy department is active in Chapter 13, 7, 11 and 12 cases. The attorneys become involved in the bankruptcy claims upon their receipt and monitor throughout all phases of the bankruptcy case. Our attorneys are equipped to handle bankruptcy cases for the Eastern District of Missouri, Western District of Missouri, Southern District of Illinois and the entire state of Kansas. In special circumstances, our bankruptcy department can handle matters in jurisdictions other than those previously stated. Matters are generally handled on an hourly fee basis. This area of practice has been expanding over the years and now includes representation of unsecured creditors committees in Chapter 11 cases.
Foreclosure
Our foreclosure department handles conventional, FHA, VA, FHLMC, and FNMA foreclosures for the entire state of Missouri and the entire state of Kansas. In addition, the department conducts evictions and works closely with the bankruptcy department on foreclosure related bankruptcy issues. The department is supported by several paralegals and administrative assistants. The department also offers counseling on real estate issues and assists clients in loan workout situations.
